General Terms and Conditions
It is a condition of riding and/or agisting a horse at Sand Dancing Pty Ltd that all riders and/or agisters agree to be bound by and accept our full Terms and Conditions as detailed below, as well as our Refund Policy

You are hereby warned and agree that entering into any Sand Dancing Pty Ltd property and/or participating in horse riding activities are inherently dangerous recreational activities pursuant to the Civil Liberty Act, 2002. If you choose to do so, you do so entirely at your own risk waiving all rights to claims for personal injuries including damages arising from the negligence of Sand Dancing Pty Ltd

Agistment Terms and Conditions
All agisters must be at least 18 years of age and have completed the Sand Dancing Waiver and Liability Release Form, New Client Form, New Horse Form and Agistment Form prior to the arrival of the agister’s horse at any Sand Dancing property. 

Payment for the first week’s agistment is required at time of booking and must be made via our website using a credit card.  All future agistment charges must be paid weekly in advance, either via our website using a credit card or in cash at our office. Any accounts overdue more then 14 days will accrue interest at a rate of 7% per month. Please be advised that AMEX is subject to a 3% surcharge. There is no surcharge for MasterCard and VISA

Please be advised that in order to eliminate credit card fraud, it is a condition of agisting with Sand Dancing Pty Ltd that any credit card used for online booking purposes needs to be present for verification the next time you attend any Sand Dancing property, as well as matching photo ID

The horse is at the agister’s risk at all times. It is the agister’s responsibility to insure the horse and any progeny against all risks whilst they are at any Sand Dancing property or being transported to or from any Sand Dancing property. Sand Dancing Pty Ltd shall not be responsible for any disease, accident, illness or injury howsoever caused or arising to the horse whilst transporting to or from any Sand Dancing property, or at any Sand Dancing property. The agister must notify Sand Dancing in writing immediately if the agister becomes aware that the horse suffers or has been in contact with any significant or notifiable sickness, disease or injury. Veterinary services for the horse and/or progeny may be provided at the discretion of Sand Dancing Pty Ltd in consultation with Sand Dancing Pty Ltd’s veterinarian. The agister will pay all veterinarian and other charges incurred whilst the horse is at any Sand Dancing Pty Ltd property

The agister gives Sand Dancing Pty Ltd a lien against the horse and progeny for payment of agistment fees and all other expenses and charges which the agister has accrued whilst the horse has been at any Sand Dancing property. This means the agister may not remove the horse or its progeny from any Sand Dancing property while any part of these Terms and Conditions are not fulfilled. Sand Dancing Pty Ltd may sell the horse and/or its progeny at public auction or by private sale, to recover any monies unpaid for 60 days after Sand Dancing Pty Ltd has sent the account. The agister irrevocably appoints Sand Dancing Pty Ltd as the agister’s attorney with power to sell the horse and/or its progeny and to sign all transfers and other documents and do everything necessary to effect and complete the sale and to retrieve the purchase price and credit it towards the costs of sale and all monies owing

All bookings are subject to our full Terms and Conditions and Refund Policy. We reserve the right to refuse entry to any Sand Dancing property and participation in any horse riding activities

Horse Riding Terms and Conditions
All riders must be at least 6 years of age and have completed the Sand Dancing Waiver and Liability Release Form. All riders under the age of 18 must be accompanied by a parent or guardian at all times whilst at a Sand Dancing property, and this parent or guardian must have separately completed the Sand Dancing Waiver and Liability Release Form
